Case Concerning the Legality of the Use of Force Against Iraq in 2003 (Republic of Iraq v. United States of America and United Kingdom of Great Britain and Northern Ireland)
AGENDA
international court of justice
The International Court of Justice (ICJ) serves as the principal judicial organ of the United Nations, tasked with resolving disputes between states through the application of international law. In a world where the use of force remains one of the most contested aspects of global politics, the Court plays a vital role in defining the legal boundaries of state conduct and upholding the principles of sovereignty and legality. This committee examines the legality of the 2003 invasion of Iraq, a moment that sparked widespread international debate. The respondent states, the United States and the United Kingdom, justified their actions on grounds including self-defense and the enforcement of prior United Nations Security Council resolutions. The Republic of Iraq, however, challenges this justification, arguing that the use of force was a violation of its sovereignty and a breach of international law. Delegates will engage with key legal principles such as the prohibition of the use of force under the UN Charter and the conditions under which self-defense may be invoked. The ICJ will deliberate on whether the actions taken in 2003 were legally justified or whether they set a dangerous precedent for dictated intervention. Through careful legal reasoning and argumentation, the Court seeks to address a basic question: when, if ever, is the use of force truly lawful?
